The New York Real Estate Broker License is the senior real estate license in New York. Unlike a salesperson - who must work under a sponsoring broker and be paid through that broker - a licensed broker can operate their own brokerage, supervise and employ salespersons, and receive commissions directly. It is issued by the New York Department of State (DOS); New York has no separate real estate commission, and the DOS regulates licensees directly under Article 12-A of the Real Property Law. It is a license, not a certification. To earn it, you must be at least 20, complete 152 hours of DOS-approved qualifying education (the 77-hour salesperson course plus a 75-hour broker course), meet the experience requirement measured in points (at least two years as a licensed salesperson with 3,500 points, or three years in the general real estate field with 5,250 points), then pass the DOS broker exam (about 2.5 hours; reported pass/fail, with no numerical score released). Fingerprinting and a background check apply.
